WEST COAST FURNITURE
TERMS AND CONDITIONS, DELIVERY, CANCELLATION, RETURN, AND WARRANTY POLICY

These Terms and Conditions apply to all purchases made from West Coast Furniture through our website, payment links, invoices, telephone orders, in-person transactions, or third-party financing providers.
By placing an order, submitting payment, signing an invoice or delivery receipt, or accepting these Terms electronically, the customer confirms that they have read, understood, and agreed to these Terms and Conditions.
Nothing in this policy limits any consumer right or remedy that cannot legally be waived.
1. CUSTOMER ELIGIBILITY AND INFORMATION
By placing an order, the customer represents and agrees that:
- The customer is at least 18 years old and legally able to enter into a binding agreement.
- All billing, shipping, telephone, email, identification, and payment information provided is accurate, complete, and current.
- The customer is authorized to use the payment method submitted.
- If purchasing on behalf of another person or business, the customer has authority to bind that person or business to these Terms.
- The customer will not use West Coast Furniture’s website, products, payment systems, or services for any fraudulent, unlawful, or improper purpose.
The customer is responsible for promptly notifying West Coast Furniture of any changes to the delivery address, telephone number, email address, access instructions, or authorized recipient.
West Coast Furniture is not responsible for delays, unsuccessful deliveries, or missed communications caused by incorrect or outdated information provided by the customer.
2. ORDER ACCEPTANCE AND AVAILABILITY
All orders are subject to:
- Product availability;
- Manufacturer and supplier availability;
- Payment approval;
- Identity and fraud verification;
- Delivery-area availability;
- Address verification; and
- Final acceptance by West Coast Furniture.
An order confirmation, payment authorization, invoice, or financing approval does not guarantee that merchandise is available.
West Coast Furniture reserves the right to decline, place on hold, correct, or cancel an order because of:
- Inventory shortages;
- Product discontinuation;
- Manufacturer cancellation;
- Pricing or product-description errors;
- Payment or identity-verification concerns;
- Suspected fraud;
- Delivery limitations; or
- Circumstances beyond our reasonable control.
If West Coast Furniture cancels an order before delivery because the item is unavailable or because of an error made by West Coast Furniture, any eligible amount collected for the canceled item will be returned through the applicable original payment method.
3. PRODUCT DESCRIPTIONS, IMAGES, AND MEASUREMENTS
West Coast Furniture makes reasonable efforts to display product descriptions, measurements, materials, colors, finishes, and images accurately. However:
- Product images may be provided by manufacturers.
- Screen settings and lighting may affect how colors appear.
- Product measurements may be approximate.
- Manufacturers may make minor design or construction changes without notice.
- Decorative accessories shown in product images may not be included.
- Color, grain, texture, pattern, stitching, hardware, firmness, and finish may vary between production runs.
The customer is responsible for reviewing the complete product description before purchasing.
Reasonable differences in color, shade, wood grain, stone veining, leather markings, fabric dye lots, texture, firmness, or finish are not normally considered damage or manufacturing defects.
4. PRICING, TAXES, AND FEES
Prices are subject to change before an order is completed.
West Coast Furniture reserves the right to correct typographical, technical, pricing, product-description, or calculation errors. If an error affects an order, West Coast Furniture may:
- Offer the corrected price;
- Offer an alternative product;
- Remove the affected item; or
- Cancel and refund the affected portion of the order.
Applicable taxes, delivery charges, shipping charges, assembly charges, financing charges, and other disclosed fees will be added to the order when applicable.
5. PAYMENT AUTHORIZATION
The customer authorizes West Coast Furniture and its payment-processing partners to charge the selected payment method for:
- Merchandise;
- Applicable taxes;
- Shipping or delivery;
- Assembly or installation services specifically purchased;
- Approved additional services; and
- Other charges disclosed and accepted at checkout or on the invoice.
Orders may be held until payment clears and billing information is verified.
A declined, reversed, disputed, fraudulent, or unauthorized payment may result in an order hold or cancellation.
West Coast Furniture may request identification, proof of billing address, cardholder verification, or a signed authorization before releasing an order.
6. THIRD-PARTY FINANCING
Financing may be provided by independent third-party companies, including Affirm and other financing providers.
West Coast Furniture does not control:
- Financing approval or denial;
- Credit limits;
- Interest rates;
- Payment schedules;
- Late fees;
- Loan servicing;
- Credit reporting;
- Financing-provider decisions; or
- The time required for an adjustment or refund to appear.
Customers are responsible for reviewing and complying with the financing provider’s separate agreement.
If West Coast Furniture approves a refund on a financed purchase, the approved amount will be submitted through the applicable financing platform. The financing provider determines how the refund affects the customer’s loan, payment schedule, interest, or remaining balance.
Customers must continue making any required payments until the financing provider confirms that the agreement has been adjusted or closed.
7. ALL SALES ARE FINAL
Except where otherwise stated in this policy or required by law, all sales are final.
West Coast Furniture does not accept returns or cancellations because:
- The customer changed their mind;
- The customer no longer wants or needs the merchandise;
- The customer found the merchandise at a lower price;
- The customer selected the wrong size, color, configuration, orientation, or model;
- The merchandise does not fit through an entrance or inside the intended room;
- The customer does not like a natural color, grain, texture, firmness, or finish variation;
- The customer failed to obtain permission from a landlord, property manager, or homeowners association;
- The customer failed to measure the delivery path or intended space;
- The customer is unavailable for delivery;
- The customer moved or experienced a personal or financial change; or
- Another household member does not approve of the purchase.
Any exception must be approved in writing by an authorized West Coast Furniture representative.
8. NONRETURNABLE ITEMS
The following items are nonreturnable unless damaged, defective, incorrectly supplied, or otherwise required by law:
- Mattresses;
- Foundations and box springs;
- Opened bedding materials;
- Pillows and other personal-use bedding products;
- Custom-made or special-order merchandise;
- Products with customized fabrics, colors, finishes, dimensions, or configurations;
- Assembled merchandise;
- Installed merchandise;
- Modified merchandise;
- Used merchandise;
- Merchandise removed from its original packaging;
- Merchandise missing original packaging, parts, instructions, or accessories;
- Clearance, liquidation, floor-model, open-box, or final-sale merchandise;
- Items damaged after delivery;
- Items damaged while being moved from the original delivery location;
- Items damaged by the customer or another party;
- Items purchased in error by the customer; and
- Merchandise used for commercial or institutional purposes unless specifically approved for such use.
9. ORDER CANCELLATIONS
Cancellation requests must be submitted in writing as soon as possible.
Submitting a cancellation request does not guarantee approval.
Cancellation requests are not accepted once an order has:
- Been released to a manufacturer, supplier, or warehouse;
- Entered processing;
- Been ordered from a supplier;
- Been allocated to the customer;
- Been picked, packed, assembled, staged, loaded, or prepared for delivery;
- Been transferred to a delivery company or freight carrier;
- Shipped;
- Been assigned a delivery route; or
- Received a confirmed delivery schedule.
An order is considered prepared for shipping or delivery when it has been released to a manufacturer, supplier, warehouse, freight company, delivery contractor, or delivery route for processing, preparation, scheduling, or transportation.
A delayed tracking or delivery-status update does not mean that an order has not been processed, prepared, or shipped.
West Coast Furniture may approve a cancellation as a one-time courtesy. Unless otherwise confirmed in writing, an approved cancellation after processing may be subject to:
- A 40% restocking fee;
- Original shipping or delivery charges;
- Return freight;
- Storage fees;
- Special-order charges;
- Payment-processing costs where legally permitted; and
- Other documented costs caused by the cancellation.
No cancellation is effective until West Coast Furniture confirms it in writing.
10. COURTESY OFFERS AND RESPONSE DEADLINES
When West Coast Furniture offers a customer a cancellation, partial refund, exchange, replacement, repair, or other exception, the offer may include a response deadline.
If the customer does not accept the offer in writing before the deadline:
- The courtesy offer may expire;
- West Coast Furniture is not required to extend or repeat the offer; and
- The order will remain subject to the original Terms and Conditions.
Silence does not constitute acceptance of a refund, exchange, replacement, or cancellation offer.
West Coast Furniture may document attempts to contact the customer using the telephone number and email address provided with the order.
11. REFUNDS
Any approved refund will normally be issued through the original payment method.
West Coast Furniture does not control how long a bank, card issuer, payment processor, or financing provider takes to post a refund.
Refunds will not normally be issued:
- In cash when the purchase was made by card or financing;
- To a different card or account;
- To a person other than the original purchaser; or
- Before authorized returned merchandise has been received and inspected.
For orders paid using more than one payment method, each approved refund portion may be returned through its corresponding original payment method.
Shipping, delivery, assembly, handling, rush, and special-service charges are nonrefundable after those services have been performed or the related costs have been incurred, except where required by law or approved in writing.
12. DELIVERY ADDRESS REQUIREMENTS
West Coast Furniture cannot deliver to:
- APO addresses;
- FPO addresses;
- PO Boxes;
- Personal or private mailboxes; or
- Locations that cannot safely or legally accommodate commercial delivery vehicles.
The customer must provide a complete and valid street address.
Customers receiving delivery at an apartment, condominium, gated property, or managed building must provide:
- Apartment or unit number;
- Gate or entry code;
- Building-access instructions;
- Loading-zone information;
- Elevator reservation information;
- Property-management restrictions;
- Certificate-of-insurance requirements, if applicable;
- Parking or permit information; and
- Any other information required to complete delivery.
The customer represents that the delivery address is accessible to commercial trucks, freight carriers, and delivery personnel.
13. CUSTOMER MEASUREMENT AND ACCESS RESPONSIBILITIES
Before placing an order, the customer is responsible for measuring:
- Exterior and interior doors;
- Hallways;
- Stairways;
- Stairwell turns;
- Landings;
- Elevators;
- Entry gates;
- Walkways;
- Ceiling heights;
- Room dimensions;
- Loading areas; and
- Every other portion of the delivery path.
The customer must also verify:
- Elevator size and weight restrictions;
- Homeowners association rules;
- Property-management rules;
- Building delivery hours;
- Street-access restrictions;
- Parking restrictions;
- Loading-dock requirements;
- Required permits; and
- Whether the selected merchandise will fit in the intended space.
West Coast Furniture is not responsible when merchandise cannot be delivered or placed because the customer failed to confirm measurements, access, restrictions, or suitability.
An item that does not fit because of customer measurement or access error remains subject to the final-sale, cancellation, and restocking provisions of this policy.
14. DELIVERY SERVICE LEVEL
The delivery service included with the order will be identified on the customer’s invoice or order confirmation.
Delivery may include:
- Curbside delivery;
- Threshold delivery;
- Room-of-choice delivery;
- White-glove delivery;
- Common-carrier delivery;
- Freight delivery; or
- Another service specifically listed on the order.
Unless expressly purchased and documented, delivery does not include:
- Assembly;
- Installation;
- Wall mounting;
- Electrical or plumbing connections;
- Removal of doors, railings, windows, or existing furniture;
- Structural modifications;
- Hoisting;
- Removal of packaging;
- Disposal of existing furniture; or
- Moving merchandise after its initial placement.
Delivery personnel are not authorized to perform services that are not included on the invoice.
15. DELIVERY DATES AND DELAYS
Delivery dates and time windows are estimates unless West Coast Furniture expressly guarantees them in writing.
Delivery may be delayed because of:
- Manufacturer delays;
- Product shortages;
- Freight interruptions;
- Traffic;
- Weather;
- Road closures;
- Vehicle or equipment problems;
- Labor shortages;
- Port delays;
- Building restrictions;
- Government actions;
- Carrier scheduling;
- Natural disasters; or
- Other circumstances beyond West Coast Furniture’s reasonable control.
To the extent permitted by law, West Coast Furniture is not responsible for lost wages, missed appointments, temporary lodging, contractor charges, storage arrangements, or other incidental or consequential costs caused by an estimated delivery date or delay.
Customers should not dispose of existing furniture, schedule contractors, permanently take time off work, or make other irreversible arrangements based only on an estimated delivery date.
16. CUSTOMER AVAILABILITY
An adult who is at least 18 years old and authorized to accept the order must be present throughout the delivery window.
The customer or authorized recipient must be prepared to:
- Provide access;
- Confirm the order;
- Inspect the shipment;
- Identify visible damage;
- Make written notations on the delivery receipt; and
- Sign for delivery.
A signature from the customer, household member, employee, building representative, doorman, property manager, agent, or other authorized recipient constitutes acceptance on the customer’s behalf, subject to properly documented concealed-damage rights.
17. MISSED OR UNSUCCESSFUL DELIVERIES
A delivery is considered unsuccessful when delivery cannot be completed because of:
- Customer absence;
- No authorized adult being present;
- An incorrect address;
- Missing gate or access information;
- Refused building access;
- An unavailable elevator;
- Failure to reserve a loading dock;
- Unsafe conditions;
- Inaccessible roads;
- Furniture that does not fit;
- Customer refusal without authorization;
- Homeowners association or property-management restrictions;
- Missing permits; or
- Another circumstance within the customer’s control.
The customer may be responsible for:
- Redelivery charges;
- Return freight;
- Storage charges;
- Additional labor;
- Carrier waiting time;
- Rescheduling fees; and
- Other actual costs caused by the unsuccessful delivery.
West Coast Furniture may require these charges to be paid before another delivery is scheduled.
Storage charges may begin when merchandise is ready but the customer cannot or will not accept delivery.
After repeated unsuccessful attempts or prolonged failure to accept the merchandise, West Coast Furniture may treat the order as refused or abandoned, subject to applicable law.
18. REFUSED DELIVERIES
The customer may refuse merchandise only when:
- Significant visible shipping damage exists;
- The damage is clearly documented on the delivery receipt;
- Photographs are taken; and
- West Coast Furniture authorizes refusal whenever reasonably possible.
Refusing delivery because of preference, buyer’s remorse, measurement error, color preference, access problems, scheduling conflicts, or any reason unrelated to verified damage or incorrect merchandise will be treated as a voluntary return.
An unauthorized refused delivery may be subject to:
- A 40% restocking fee;
- Original shipping or delivery charges;
- Return freight;
- Storage charges;
- Redelivery fees; and
- Other documented costs resulting from the refusal.
19. DELIVERY SAFETY
Customers, household members, guests, children, and pets must remain a safe distance from delivery personnel, trucks, loading ramps, lifts, dollies, equipment, and merchandise.
Customers should not enter a delivery truck or attempt to help unload merchandise unless specifically instructed and authorized by the delivery company.
To the extent permitted by law, West Coast Furniture is not responsible for injury or property damage caused by:
- Customer interference with unloading;
- Unsafe access conditions;
- Undisclosed property hazards;
- Pets or children;
- Customer-provided assistance;
- Unauthorized assembly or installation; or
- Movement of merchandise after delivery.
20. INSPECTION BEFORE SIGNING
The customer or authorized recipient must inspect the shipment before signing the carrier’s delivery receipt.
The customer should:
- Count all cartons and pieces.
- Inspect the packaging for tears, punctures, crushing, water damage, or impact marks.
- Inspect the merchandise when reasonably possible.
- Take photographs of the packaging and merchandise.
- Write detailed damage or shortage information on the delivery receipt.
- Keep all packaging and materials.
- Contact West Coast Furniture immediately.
Do not write only “subject to inspection.” Describe the actual condition, such as:
- “Box crushed on right corner”;
- “Fabric torn on left side”;
- “Glass broken”;
- “Wood frame cracked”; or
- “Two cartons missing.”
The carrier may not be required to open, uncrate, assemble, or inspect the merchandise. The customer remains responsible for completing a reasonable inspection.
21. VISIBLE DAMAGE, SHORTAGES, OR INCORRECT MERCHANDISE
Visible damage, missing pieces, shortages, and incorrect items must be noted on the carrier’s delivery receipt before it is signed.
The customer must notify West Coast Furniture immediately and no later than 48 hours after delivery.
The customer must provide:
- Customer name;
- Order number;
- Delivery date and time;
- A description of the issue;
- A photograph of the entire item;
- Close-up photographs of the damage;
- Photographs of the packaging;
- A photograph of the model or item label;
- A photograph of the delivery receipt; and
- Any other reasonable documentation requested for the claim.
Failure to document visible damage on the delivery receipt may affect the ability to obtain a remedy from the carrier.
Nothing in this provision eliminates a consumer right or warranty remedy that cannot legally be waived.
22. CONCEALED DAMAGE
Concealed damage is damage that could not reasonably be seen until the item was unpacked.
When concealed damage is discovered, the customer must:
- Stop unpacking the merchandise.
- Keep all original packaging.
- Photograph the merchandise and packaging.
- Avoid assembling, installing, using, repairing, or discarding the item.
- Notify West Coast Furniture immediately and no later than 48 hours after delivery.
West Coast Furniture may require the customer, as the consignee, to provide or submit documents needed for a concealed freight-damage claim.
Failure to preserve packaging, provide photographs, or cooperate with the claim process may affect the ability to obtain a carrier or manufacturer remedy.
23. NO UNAUTHORIZED RETURNS
West Coast Furniture does not accept merchandise returned without prior written authorization.
The customer must receive written authorization before:
- Returning merchandise;
- Delivering merchandise to a warehouse;
- Shipping merchandise;
- Refusing delivery;
- Hiring another company to transport merchandise; or
- Disposing of damaged merchandise.
Unauthorized returns may be refused, and the customer may remain responsible for transportation, storage, handling, or disposal fees.
Return authorization does not automatically guarantee a refund. All returned merchandise is subject to inspection and the conditions included in the written authorization.
24. DAMAGE AND DEFECT REMEDIES
When a timely claim is verified, West Coast Furniture may, depending on the circumstances and applicable law:
- Provide a replacement part;
- Arrange a repair;
- Replace the affected item;
- Exchange the affected component;
- Provide a manufacturer-approved remedy;
- Offer store credit;
- Approve a partial refund; or
- Approve another reasonable solution.
West Coast Furniture may inspect and attempt repair or replacement before issuing a refund, except where the law requires a different remedy.
For orders containing multiple items, a verified issue with one item does not automatically entitle the customer to reject or receive a refund for unaffected merchandise.
Any approved credit or refund will ordinarily be limited to the value of the affected merchandise or component, except where a greater remedy is required by law.
The customer must provide reasonable access for inspection, repair, replacement, or pickup.
25. NATURAL MATERIALS AND FINISHES
Leather, wood, stone, marble, fabric, veneers, metal, and other materials may naturally vary in:
- Color;
- Shade;
- Texture;
- Grain;
- Veining;
- Knots;
- Natural markings;
- Distressing;
- Dye lot;
- Pattern;
- Firmness;
- Stitching; and
- Finish.
These variations are part of the character of natural and manufactured materials and are not normally considered defects.
Leather colors may vary between production runs. Wood and stone products may include natural markings, grain differences, knots, veining, shade changes, or mineral deposits.
Computer screens, mobile devices, lighting, photography, and display settings may cause product colors to appear different from the actual merchandise.
Customers should request a sample before ordering when an exact shade or finish match is important. Samples are illustrative and may not perfectly match the final merchandise.
26. LIMITED PRODUCT GUARANTEE
Unless a separate written manufacturer warranty applies, West Coast Furniture’s responsibility for a verified defect is limited to repair or replacement of the defective item or component at West Coast Furniture’s reasonable discretion, subject to applicable law.
This guarantee applies only to:
- The original purchaser;
- Normal residential household use;
- The original delivery location unless otherwise approved; and
- Merchandise used and maintained according to the manufacturer’s instructions.
This guarantee does not cover:
- Normal wear and tear;
- Comfort preferences;
- Normal softening or settling of cushions;
- Fabric pilling;
- Minor noises caused by normal product movement;
- Fading caused by sunlight;
- Damage caused by humidity, heat, moisture, pets, insects, or environmental conditions;
- Scratches, chips, rips, tears, stains, burns, dents, or broken glass occurring after delivery;
- Improper cleaning;
- Improper assembly;
- Unauthorized repair;
- Misuse, abuse, negligence, or accidents;
- Moving merchandise after its original placement;
- Use on an uneven surface;
- Failure to follow care instructions;
- Commercial, institutional, rental, or business use;
- Alteration or modification;
- Damage caused by a third-party mover or installer;
- Natural material or dye-lot variations; or
- Damage that was not reported within a reasonable period when timely notice was necessary to investigate the claim.
Any manufacturer warranty is controlled by the manufacturer’s written terms.
Nothing in this section eliminates any warranty or consumer protection that cannot legally be waived.
27. COMMERCIAL USE
Unless merchandise is specifically sold and warranted for commercial use, West Coast Furniture products are intended for normal residential household use.
Use in a business, office, rental property, short-term rental, hotel, waiting room, event venue, school, care facility, restaurant, or other commercial or institutional setting may void any residential-use guarantee.
28. PAYMENT DISPUTES AND CHARGEBACKS
Customers are encouraged to contact West Coast Furniture and provide a reasonable opportunity to resolve an order concern before initiating a payment dispute.
A chargeback does not automatically cancel an order, create a return authorization, or allow a customer to keep both the merchandise and the disputed funds.
West Coast Furniture may respond to a payment dispute by submitting relevant documentation, including:
- Order records;
- Checkout acceptance records;
- Terms and Conditions;
- Payment authorizations;
- Customer emails, messages, or telephone records;
- Delivery photographs;
- Tracking information;
- Signed delivery receipts;
- Address-verification records;
- Financing information;
- Repair or replacement offers; and
- Other evidence related to the transaction.
The customer remains responsible for any valid and undisputed balance.
Nothing in this provision prevents a customer from exercising a lawful billing-error or dispute right.
29. FRAUD AND UNAUTHORIZED TRANSACTIONS
West Coast Furniture may delay, investigate, decline, or cancel an order that appears fraudulent or unauthorized.
Customers agree not to:
- Use another person’s identity or payment method without authorization;
- Provide false billing or delivery information;
- Make false claims of nondelivery or damage;
- Submit altered or false documentation;
- Attempt to retain merchandise after receiving a refund;
- Misrepresent a transaction to a payment provider; or
- Abuse a financing, refund, return, or dispute process.
West Coast Furniture may report suspected fraud, theft, forged documents, or payment abuse to payment providers, financing providers, delivery companies, law enforcement agencies, or other appropriate parties.
30. PRIVACY AND INFORMATION SHARING
West Coast Furniture may collect information needed to:
- Process orders;
- Verify identity;
- Process payments;
- Review financing applications;
- Prevent fraud;
- Arrange delivery;
- Provide customer service;
- Handle warranty and damage claims;
- Comply with legal requirements; and
- Maintain business records.
Information may be shared with service providers involved in these activities, including:
- Payment processors;
- Banks and card networks;
- Financing providers;
- Manufacturers;
- Suppliers;
- Warehouses;
- Delivery companies;
- Freight carriers;
- Fraud-prevention providers;
- Website and technology providers;
- Insurers;
- Accountants;
- Attorneys; and
- Government authorities when legally required.
West Coast Furniture does not sell customer information merely because the customer places an order.
31. CUSTOMER COMMUNICATIONS
The customer agrees to receive transactional communications regarding the order through:
- Email;
- Telephone;
- Text message;
- Financing-provider communication;
- Website notification; or
- Mail.
Transactional communications may include:
- Order confirmations;
- Payment verification;
- Delivery scheduling;
- Delay notifications;
- Damage-claim requests;
- Cancellation notices;
- Refund information; and
- Account-security communications.
Customers are responsible for checking spam, junk, blocked-call, and voicemail folders and for maintaining current contact information.
32. COUPONS AND PROMOTIONS
Coupons, discounts, and promotional offers:
- Have no cash value;
- Cannot be applied retroactively;
- Cannot be combined unless expressly permitted;
- May exclude certain products or brands;
- May be limited to one per order;
- Are subject to expiration dates;
- May be canceled in cases of error, misuse, or fraud; and
- Are not valid for app purchases unless expressly stated.
Coupons do not apply to taxes, shipping, delivery, financing charges, previous purchases, or other excluded charges unless expressly stated.
Any refund on a discounted item will not exceed the amount actually paid for that item.
33. FORCE MAJEURE
West Coast Furniture is not responsible for delays or failure to perform caused by events beyond its reasonable control, including:
- Natural disasters;
- Fire;
- Flood;
- Earthquake;
- Severe weather;
- Epidemics or pandemics;
- War;
- Terrorism;
- Civil unrest;
- Government orders;
- Labor disputes;
- Port congestion;
- Transportation interruptions;
- Fuel shortages;
- Utility or internet outages;
- Cybersecurity incidents;
- Supplier failures;
- Carrier breakdowns;
- Material shortages; or
- Similar circumstances beyond our reasonable control.
West Coast Furniture will make reasonable efforts to notify affected customers and resume performance when reasonably possible.
34. LIMITATION OF LIABILITY
To the maximum extent permitted by law, West Coast Furniture is not responsible for indirect, incidental, special, exemplary, punitive, or consequential damages arising from an order, delivery delay, product issue, or use of the website or merchandise.
This may include:
- Lost wages;
- Lost profits;
- Missed appointments;
- Contractor charges;
- Hotel expenses;
- Rental expenses;
- Replacement-furniture expenses;
- Loss of use;
- Emotional distress; or
- Damage caused by later movement, installation, modification, or misuse of merchandise.
To the extent permitted by law, West Coast Furniture’s total liability concerning an affected product will not exceed the amount the customer actually paid for that product.
Nothing in these Terms excludes liability that cannot legally be limited, including liability caused by fraud, intentional misconduct, or another nonwaivable legal obligation.
35. INDEMNIFICATION
To the extent permitted by law, the customer agrees to indemnify and hold harmless West Coast Furniture and its owners, affiliates, officers, employees, agents, contractors, manufacturers, suppliers, warehouses, and delivery partners from third-party claims, losses, damages, liabilities, and reasonable expenses arising from:
- The customer’s misuse of the website or merchandise;
- False or unauthorized information supplied by the customer;
- Unsafe delivery conditions controlled by the customer;
- Customer interference with delivery personnel;
- Customer modification, movement, assembly, or installation;
- Commercial use of residential merchandise;
- Violation of these Terms; or
- Violation of another person’s rights.
This section does not require the customer to indemnify West Coast Furniture for liability that cannot legally be shifted to the customer.
36. GOVERNING LAW AND VENUE
These Terms and Conditions are governed by the laws of the State of California.
Unless prohibited by law, any legal proceeding related to an order shall be brought in a court with proper jurisdiction in the California county where West Coast Furniture maintains its principal place of business.
Nothing in this section prevents either party from using a lawful small-claims procedure or another remedy that cannot legally be waived.
37. ATTORNEY’S FEES AND COSTS
In a legal proceeding arising from these Terms, the prevailing party may recover reasonable attorney’s fees and costs only where permitted by applicable law, contract, or court order.
38. SEVERABILITY
If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted or removed as necessary.
The remaining provisions will continue in full effect.
39. NO WAIVER
West Coast Furniture’s failure to enforce a provision on one occasion does not waive the right to enforce that provision later.
A courtesy refund, cancellation, exchange, repair, replacement, discount, delivery accommodation, or policy exception does not permanently change these Terms and does not require West Coast Furniture to offer the same exception in another situation.
40. ENTIRE AGREEMENT
These Terms and Conditions, together with the customer’s invoice, order confirmation, product description, financing agreement, delivery documentation, written warranty, and any written amendment accepted by West Coast Furniture, make up the entire agreement concerning the order.
A verbal statement made by an employee, salesperson, manufacturer, or delivery person does not modify these Terms unless confirmed in writing by an authorized West Coast Furniture representative.
If an invoice contains a specific written term that conflicts with a general provision in this policy, the more specific written order term will apply to that transaction, except where prohibited by law.
41. POLICY UPDATES
West Coast Furniture may update these Terms and Conditions from time to time.
The version accepted when the customer places the order will generally apply to that order unless:
- The customer and West Coast Furniture agree otherwise in writing; or
- A change is required by law.
42. ELECTRONIC ACCEPTANCE
By completing a purchase, the customer confirms:
“I have reviewed and agree to West Coast Furniture’s Terms and Conditions, including the All Sales Final Policy, Cancellation Policy, 40% Restocking Fee, Delivery and Measurement Responsibilities, Damage-Inspection Requirements, Third-Party Financing Terms, and Warranty Limitations.”
